The Terms and Conditions of sale for villency.com. By completing a purchase with us you agree to follow these Terms and Conditions and to be bound by them.

General Terms

In some cases, merchandise displayed for sale on our Web Site may occasionally be out of stock or may be discontinued without notice. Some items shown on our Web Site are only available in Maurice Villency Showrooms.
All prices and services featured on our Web Site are quoted in U.S. Dollars, are valid and effective only in the continental U.S.
Every effort has been made to ensure the accuracy of prices, item numbers, availability, and dimensions; however, we cannot be responsible for typographical errors. We reserve the right to correct any errors or omissions.
Wood/veneer species, product composition, and manufacturing techniques vary by product and may change over time without notice. Final products may vary in color, finish, size, fabric, or other features.  
The total order amount, including tax and delivery charges, will be charged to your credit or debit card in full, at the time the order is placed. 
State taxes will be charged if the purchase is made by an inhabitant of New Jersey or New York State.

Delivery Process
The estimated ship date is an estimate of the approximate date the product is expected to ship from our manufacturing facility to your home. The ship date is subject to change. We will endeavor to keep you informed on the progress of your order. All items are custom made and typically will ship to you within 30 days.
We will make an "in-home" delivery Monday to Friday from 8:00 am to 5:00 pm. Items will we placed in the room of your choice. You will be called to schedule an "in-home" delivery and will be provided a three hour to four-hour time window for your delivery. Delivery is subject to reasonable and safe access. Hoisting and any other extraordinary measures necessary to accomplish delivery are at your risk and any additional cost must be paid by you at or before the time of delivery.  
A minimum re-delivery fee of $100.00 will be charged to the original credit or debit card if you are not at home, unable to, or do not accept a scheduled delivery and a second "in-home" delivery is required.
A storage fee of 3% per month of the total order amount will be charged to the original credit or debit card used for the purchase if delivery is not accepted within thirty (30) days after notice of availability of merchandise for delivery. If you fail to accept delivery for ninety (90) days after notice of availability of merchandise for delivery, at our sole option and at any time thereafter, we will cancel your order and refund your payment less any unpaid storage fees and a 25% cancellation fee.

Order Cancellations
We will fully refund an order if cancelled within 48 hours of purchase. After 48 hours, we will accept a cancellation with a 25% cancellation fee if the item has not shipped. If the item has been shipped, the return policy and procedures outlined below must be followed. To cancel an order placed on villency.com please contact our Service Department at 877-800-8583.

Return Procedure
Within three (3) days of receiving the product contact our Service Department at 877-800-8583 to facilitate your return. If authorized, a pick up will be scheduled. If you receive a damaged, defective, or incorrect item service will be provided at no charge.
If we accept a cancellation of your order a cancellation fee equal to 25% of the purchase price and an "in-home" delivery pick up charge will be deducted from your refund. A credit will be issued to the original credit or debit card used for the purchase within fifteen (15) days of return of the product. Refunds generally appear on your credit card statement in one to two billing periods.

We regret that we cannot accept returns that are not authorized by our Service Department within three (3) days of your receipt of the product. We do not accept any returns on mattresses and box springs. "In-home" delivery charges are not refundable. You are responsible for the return shipping (pick up) charges.

Maurice Villency Quality Guarantee
Maurice Villency proudly guarantees that our furniture will be free of manufacturing or material defects for as long as you own it.

The frame, springs and webbing construction should be free of defects due to faulty materials or workmanship under normal household use for the lifetime of the product. Softening of springs and webbing over time is normal and expected. The mechanisms in our sleep-sofas, incliners, recliners, swivel and/or rocker chairs should last under normal household use for at least five years.

The seat cushion cores and other padding materials will stand up under normal household use for at least three years.

Softening of Inner Spring Soy Cushion foam is normal and expected. All foams will soften and lose height with use. These changes are not to be considered defects in material workmanship. Filling materials will also soften and conform to the shape of the users; this is also considered normal and should not be viewed as a defect.

All mattresses will soften with use. Naturally, mattresses folded inside sofa-bed mechanisms will become creased at the fold lines.

Upholstery Fabric
For at least two years, under normal household use, there should be no yarn slippage at the seams, shrinkage, or failure of seam construction. We warrant the fabric for two years from the date of purchase against dye transference provided the fabric has been professionally cleaned. The maturing of fabric frequently involves wrinkling, pilling or fading and is part of the aging process. Our responsibility does not include fabric failure as a result of cuts, burns, stains, pet damage, improper cleaning, or chemical treatments. Please do not remove covers for cleaning.

Due to differences in dye lots and alteration of coloration over time, Maurice Villency cannot guarantee the exact match of color shades in fabric repair.


Leather
Under normal household use, leather should neither tear nor split. Wrinkling or natural markings from injuries to the skin, variations in grain or color are normal and are proof that only real cowhide leather has been used. Damage due to burns, cuts or pets are not our responsibility. We caution against improper cleaning, abuse, negligence and treatment with chemical products. Do not expose leather to sun, extreme heat or bright lights, such as sun lamps. We are not responsible for spills such as acids, solvents, dyes or other corrosive chemicals, ink, paint, or body fluids.

How to Obtain Service
Subject to the above limitations, we will repair or replace at Maurice Villency's discretion, any part or parts of the product, which do not perform properly due to faulty materials or workmanship. For service, report any problems to our Service Department at 877-800-8583 or e-mail us at service@villency.com. Maurice Villency reserves the right of inspection to determine if servicing may be completed in your home, or if we must arrange transportation of the furniture to our repair facility. Evidence of original purchase, such as invoice or sales order will be required prior to any necessary repair.

Maurice Villency is not responsible for any incidental or consequential damages and in no event shall the responsibility of Maurice Villency exceed the purchase price of the product or its replacement. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the forgoing limitation or exclusion may not apply to you. These representations are made only to you, the original purchaser and do not cover merchandise purchased as second-hand, distressed or "as is". They do not apply to furniture which has been subject to abuse, improper care, abnormal use, or which has been moved from the original delivery address. Nor do they include commercial, contract, rental, trade, institutional or other non-residential usage.

Changes to The Terms and Conditions of Sale for villency.com. Maurice Villency may update or modify these Terms and Conditions at any time and without prior notice. For this reason, you should review these Terms and Conditions each time you purchase products from us.

Legal
Any action relating to the use of villency.com must be brought in the state or federal courts located in the State of New York.
